Sporting Rights

Sporting rights are owned within the title and are included within the sale.  Fishing rights are reserved together with a right to use the access lane to a small car park created within enclosure 9.

 

Mineral Rights

Mineral rights are reserved from the sale.

 

 

STIPULATIONS

 

General Conditions

The property is offered freehold with vacant possession upon completion.

 

Countryside Stewardship and Entry Level Agreements

The current Vendor has an active Countryside Stewardship Agreement with both capital and management options employed.  There is also an Entry Level Scheme in place.  Copies of documents relating to both schemes are available for inspection at the Agents’ offices.

 

The Purchaser shall be required to take over the schemes and maintain same until the conclusion of the current schemes, indemnifying the current Vendor against any subsequent liabilities which may occur under the schemes in respect of the area to be purchased.

 

Single Payment Scheme

The Vendor shall reserve all payment in respect of the 2008 scheme year.  The Purchaser shall acquire the entitlements at an agreed market value for the 2009 scheme onwards in respect of the claim area extending to 35.04 hectares of entitlement.

 

The transfer of the entitlement shall be co-ordinated by Messrs Addisons Chartered Surveyors.

 

Easements and Rights

1)     The land is sold subject to rights of way in favour of the owners of Waterside Cottages.

2)     Subject to wayleave agreements for NEDL apparatus serving Waterside Cottages and other properties.

3)     Drainage easements from Waterside Cottages.

4)     Rights of access in favour of the Angling Club both with car to the main road access and then on foot to the River Wear.

5)     All of the rights, benefits, easements, quasi easements or reputed easements from any party whatsoever, together with all existing proposed rights, easements, wayleaves and other matters registered by any competent authority, or subject to statutory creation.

 

Water

The land is watered via a mains supply and the purchaser shall be responsible for division of supply.  The Vendor retains the right to connect supply to retained land subject to contributing towards the standing charge on a proportional basis and paying for water consumed.

 

Boundaries

Boundary responsibilities where known are indicated by T-marks on the attached plan.

 

Development Clawback

The land is sold subject to a development clawback arrangement in favour of a previous Vendor who has a retained proportion of the benefit of any uplift in value as a result of the receipt of planning permission.  Further details can be obtained from the Vendor’s Solicitors.

 

Tenant Right Matters

Neither the Vendor nor Purchaser shall make any claim whatsoever one against the other except expressly referred to within these particulars in respect of tenant right matters.
