FOR SALE BY INFORMAL SEALED TENDER A particularly well positioned block of potential development land known as Catchpenny, Gainford, with long road frontage to Council maintained road and gated access at two points to the northern boundary from Council maintained road. The site lies within a Conservation Area defined within Durham County Council Local Plan. Catchpenny is offered as a whole or in three lots and comprises :- Lot 1 1.33 acres (0.538 hectares) or thereabouts, edged orange on the attached plan Accommodation land with access east of the Lord Nelson public house to its northern boundary. The property is well defined with fences and walls and comprises permanent grassland with a large road frontage. Lot 2 0.22 acres (0.089 hectares) or thereabouts, edged blue on the attached plan Garden area with access to Council maintained road to its northern boundary. Lot 3 0.30 acres (0.122 hectares) or thereabouts, edged red on the attached plan Allotment area extending to five large allotments, within a walled site, with separate pedestrian access to the road, fully enclosed. SALE The land is offered for sale freehold, subject to the following occupations :- a) Lot 1 Grazing Licence in favour of an agricultural Tenant, the current rental charge being £80 per annum. b) Lot 2 The property is let on a Garden Licence at an annual rental of £110 per annum. c) Lot 3 The area is split into five allotments, the rental for each allotment being £20 per allotment per annum. Method of Sale The sale shall be by means of Informal Tender. All tenders should be received by Friday 6 November 2009 by 5.00 pm at the Agents offices. Tenders shall be completed in writing specifying all terms which apply to the tendered offer. Interested parties may bid in the alternative for lots in different combinations by means of completing a separate tender in respect of each alternative. The parties who are accepted agree to exchange contracts within 14 days of acceptance and to complete within 28 days thereafter. STIPULATIONS Development Clawback The Vendors will retain a development clawback of 50% of any uplift in value in respect of Lot 1 and 75% of any uplift in value in respect of Lots 2 and 3 over a period of 20 years from the date of sale. The Vendors shall retain a ransom strip to the southern and eastern boundaries between Points A, B and C as marked upon the attached plan. The Vendors reserve the right to the current years rentals from the allotment, garden and agricultural tenants. Easements and Wayleaves The land is sold subject to all Easements and Wayleaves so far as they are in, on, under or over the said property. The Vendor reserves the right to create such rights of way / easements as are necessary for means of access between divided use as necessary following sale agreement. Boundaries So far as known, the boundary walls that are marked with inward facing T-marks are the responsibility of the property. Any walls left unmarked are left as there is no understanding as to the liability for the maintenance of the said boundary/boundaries. Planning Matters The area has been entered into initially the Teesdale District Council and subsequently Durham County Council Strategic Housing and Land Availability Assessment. The current status of the land as at the date of dictation of these particulars is that it has the status of being recognised as land coloured orange, which indicates its potential suitability for future involvement within any development plan should the need arise for such development within the Gainford area. This view is subject to potential change with further ongoing representations to the Durham County Council Strategic Housing Land Availability Assessment year on year.
